participant (“Participant”) and GVO Studios, LLC, its owners, members, managers, officers,
employees, instructors, contractors, agents, affiliates, and successors (collectively, the
“Studio”).
1. Description of Activities
The Studio provides yoga, Pilates, barre, and other wellness instruction, classes,
workshops, events, and related activities (collectively, the “Activities”). These may occur at
the Studio’s premises or at off-site locations, including but not limited to yoga retreats,
workshops, or other wellness events organized or facilitated by the Studio (“Off-Site
Activities”). Off-Site Activities may involve travel, different environments, and additional
physical demands associated with retreat settings.
2. Assumption of Risk
The Participant acknowledges and understands that participation in the Activities involves
inherent risks of physical injury, illness, or other harm, including but not limited to muscle
strains, sprains, joint injuries, falls, exacerbation of pre-existing conditions, or more serious
injuries. These risks may arise from the Participant’s own actions or inactions, the actions or
inactions of others, equipment use, environmental conditions, or the ordinary negligence of
the Studio or its personnel.
The Participant represents and warrants that they are in good physical and mental health,
are aware of their own physical limitations, and have consulted with a qualified healthcare
professional regarding any medical conditions, injuries, or concerns that may affect their
ability to participate safely in the Activities. The Participant further confirms that the
Activities are not a substitute for medical advice, examination, diagnosis, or treatment.
3. Acknowledgment of Health Responsibilities
The Participant agrees that it is their sole responsibility to assess their fitness level and to
seek guidance from a licensed healthcare professional before participating in any Activities,
particularly if they have any medical conditions, are pregnant, have recently undergone
surgery, or have any other health concerns. The Participant agrees to inform the Studio of
any relevant medical information and to discontinue participation immediately if they
experience discomfort or believe it is unsafe to continue.
4. Waiver and Release of Liability
In consideration of being permitted to participate in the Activities, including any Off-Site
Activities, the Participant, on behalf of themselves, their heirs, executors, administrators,
assigns, and personal representatives, hereby voluntarily releases, waives, discharges, and
covenants not to sue the Studio from any and all liability, claims, demands, actions, or
causes of action arising out of or related to participation in the Activities. This release
includes, but is not limited to, any claims for personal injury, illness, death, property
damage, or other losses, whether caused by the ordinary negligence of the Studio or
otherwise, to the fullest extent permitted by South Carolina law.
This Waiver is intended to be as broad and inclusive as permitted by law in the State of
South Carolina and shall be governed by the laws of South Carolina. If any portion is held
invalid, the remainder shall continue in full legal force and effect.
5. Indemnification
The Participant agrees to indemnify, defend, and hold harmless the Studio from any and all
claims, liabilities, damages, losses, or expenses (including reasonable attorney’s fees)
arising from the Participant’s participation in the Activities or any breach of this Waiver.
6. Media Release
The Participant grants the Studio permission to use any photographs, videos, or other
recordings of the Participant taken during the Activities for promotional purposes, unless the
Participant provides written notice otherwise.
7. Severability and Entire Agreement
This Waiver constitutes the entire agreement between the Participant and the Studio
regarding liability and supersedes any prior understandings. The Participant acknowledges
that they have read this Waiver carefully, understand its terms, and sign it voluntarily. |
